Man, do I need help!

My story is long and complex, and I don't even know where to start, so I will just start here and fill in. I am sitting looking at a C&R form and it looks like Greek to me. After two days online searching and researching, I still have so-o-o-o-o many questions, and I can't seem to find an attorney to even help at all. My attorney dropped this after "an event" with someone in his firm caused a "conflict of interest", but because this is a case w/a local govt it seems no one wants to deal with it. I could be wrong, but none-the-less, I have questions I can't get answered. I did find another attorney to look at it and he told me that there was an error on the part of the first attorney because he missed a filing deadline, so I was a bit afraid that if I wrangled much that I would lose even the $2500.00 and wind up with nothing. Does anyone know what the filing and response dealines are for these cases, or a simple way for me to find out...not only are my arms dead from all this computer stuff, my eyes are crossing. To make matters worse, I don't understand all the initials on this site, or much of the language. I am not an idiot, I swear, but this is a whole new jungle for this animal!

In short, I have had 6 surgeries for CMT bilateral Carpal Tunnel and Cubital Tunnel. I don't even have a problem just closing this chapter (especially after reading all these nightmare stories on this site! Youch!), but I am afraid that if I sign this off I won't be able to get any Rehabilitation. I am just ignorant enough to think that the State Department of Vocatinal Rehab is something that is independant from Worker's Compensation Voc Rehab...and I don't know if it is or not?! Also, can anyone tell me if this seems like a reasonable amount of money for this type of injury? There are some complicating factors, as always, but six surgeries (3 each arm/hand, and two pieces of bone) seems like a lot for such low compensation?

I don't even know where to start. I found this site by trying to find out what a "Thomas v Sports Chalet" finding was, I still have no idea what a "Sumner" is. In my searches, I did find a CAAA and got a list of attorneys in this area, but I don't know if I can (or dare?) try to fight for more at this point. If anyone can help me, I would greatly appreciate it.

Hi, and welcome to WCC...you will find lots of help and information here from some very knowledgeable pros who are kind enough to come over from 'their side'....
But it isn't necessary to post the same questions in more than one forum...it's excessive and creates extra reading for those who do offer assistance...

Hi Mystified--it is my understanding that the State Department of Voc Rehab is separate from the Voc Rehab that you may (or may nor receive) under Workers Comp. I believe Ginger, in a previous post under this category, addressed this issue. Now, this was several months ago, and I cannot recall the specifics.

It is my BASIC understanding that if you are deemed "disabled", or you settle out the Voc Rehab benefits, you can avail yourself of these services. BUT--CALL YOUR LOCAL STATE REHAB OFFICE-- I am sure that they will be able to let you know exactly what documentation you need to provide to them in order to participate in their services.

In the interim, perhaps more proficient posters can clarify what benefits are under the State Voc Rehab System so that other IWs can have a better understanding of IF/HOW to obtain them.

rumbler is correct vocational rehabilitation under the workers' compensation insurance is a totally different benefit then the benefit offered by the California Department of Rehabilitation, they are independent of each other, one a state agency and the other workers' compensation insuranc.

Different qualifiers, different benefits available.

However if you have a Thomas finding this does not allow for any vocational rehabilitation under the work comp scenario. Given the settlement level of your case, the IC just does not want to litigate and it appears they have a pretty strong case regarding the non-industrial basis of your alleged injury.

The Sumner case basically said that you were compromising your death benefits, that is all, which is doubtful that you would have died within 5 years of the date of your alleged injury anyway.
