Hello....

Haven't been here in a while so here's a little background:

DOI: 3/2002

Got Voc. Rehab. approval and actually saw a counselor(referred by my lawyer) maybe 2 years ago. Been putting it on interrupt since i wanted to concentrate on finding out why i'm not getting better.

Got dx with Thoracic Outlet Syndrome and 2 other possible conditions recently. Found out i have nerve and blood vessel compressions. I'm still on TTD and needs further testing and possible surgery this year.

Question:
I sent in my acceptance to cont. my VR last Jan. and just got a call from my VR counselor that it's been approved. I know what i want to do(hopefully gets an ok) and which school to go to(BPPVE approved). But, i'm now having second thoughts if it's such a good idea to go to school right now knowing i will probably go ahead with the surgery this year.

I am seriously considering asking the ins. company to buy me out instead. Am i making a huge mistake? Will i mess my VR up by asking for a buy out?

Well, you can only "buy-out" your VR at the IC's discretion, and only then once your medical condition has stabilized and the parties know what you are capable of physically.

There is no requirement that the insurance company has to buy you out.

The question for any vocational rehabilitation plan is if you were only 10% better then you are now, could you do the job?

That is considering the worst case scenario.

If your surgery is not soon, remember not to let this benefit lapse as there is a sunset clause that says all VR ends 1/1/09. So since we won't have case law, we don't know if it is just all said and done or if you are in a plan prior to 1/1/09, you remain entitled to the benefit.

Also we anticipate the case law will address what if the insurance co, caused significant delays that did not allow you to get started?
